NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL PRIZES AWARDED STRICTLY IN ACCORDANCE WITH THE OFFICIAL CONTEST RULES.
- ELIGIBILITY: "Share the Experience™ 2009" Official Federal Recreation Lands Photo Contest (the "Contest") is open only to legal residents of the fifty United States and DC, 18 years of age or older as of May 4, 2009. All employees of the National Park Foundation and Olympus Imaging America Inc. (collectively, the "Sponsors"); ePrize, LLC (the "Administrator"); National Park Service, Bureau of Land Management, U.S. Fish & Wildlife Service, Bureau of Reclamation, U.S. Forest Service (collectively the "Federal Recreation Agencies"); and their respective parent companies or organizations, subsidiaries, affiliates, sales representatives, distributors, manufacturers, licensees and agents, advertising and promotion agencies, and their immediate family members (spouses, parents, children, siblings grandparents, and their respective spouses) and persons living in the same household of each, are not eligible to participate in this Contest. Photographers who derive 5% or more of their income from taking photographs are also ineligible. All applicable federal, state, municipal, and local laws and regulations apply. Void where prohibited. The Contest consists of two (2) separate categories, the America at Its Best Category (the "America at Its Best Category") and the Federal Recreational Lands Pass Category (the "Federal Recreational Lands Pass Category").
- CONTEST PERIOD: The Contest runs between 12:00 a.m. Eastern Time ("ET") on May 4, 2009 Ends at 11:59 p.m.ET on January 31, 2010 (the "Contest Period"). The Contest Period consists of the three (3) phases (each, a "Phase", collectively, the "Phases") as set forth in the chart below:

Administrator's computer is the official time keeping device for the Contest. - HOW TO ENTER: There are two (2) ways to enter the Contest.
a. To enter online: During the Contest Period, visit www.sharetheexperience.org, and follow the links and instructions to register for the Contest and submit up to three (3) total photo Entries (as defined in Section 4 below). The photographs must be taken in one of the Federal Recreation Agency Lands between January 1, 2009 and December 31, 2009. You must indicate on the registration form which Category (either the America at Its Best Category or the Federal Recreational Lands Pass Category) you wish to submit your photographs into. If you choose to submit your photographs into the Federal Recreational Lands Pass Category or America at Its Best Category, you must indicate to which Federal Recreation Agency Lands (as defined below in Section 4) the photograph corresponds. Online Entries must be received by 11:59 p.m. ET on December 31, 2009.
b. To enter via mail: During the Contest Period, hand print your name, address, day and evening phone numbers, email address (if any), age and which Category (either the America at Its Best Category or the Federal Recreational Lands Pass Category), you wish to submit your photographs into, on a 3" x 5" piece of paper. Indicate the category for which you are submitting a photograph by writing either "America at Its Best Category" or "Federal Recreational Lands Pass Category". Mail it in a hand-addressed, stamped envelope with your photograph(s) to: "Share the Experience™ 2009 Official Federal Recreation Lands Photo Contest" c/o National Park Foundation, 1201 Eye Street, NW, Suite 550B, Washington, DC 20005. All mail-in Entries must be postmarked by December 31, 2009 and received by the close of business on January 8, 2010. LIMIT: one (1) entry per separately mailed envelope, up to three (3) total photo Entries.
For purposes of these Official Rules, the word "Contestant" shall refer to the individual submitting an Entry during the Contest Period. The word "Contestants" shall collectively refer to all individuals submitting Entries during the Contest Period.
By entering, Contestants represent and warrant that the Entries that they submit:
- Are their own original creations;
- Do not infringe any other person's or entity's rights; and
- Have not been submitted previously in a contest of any kind.
Limit: Each Contestant may enter up to a total of three (3) photographs in either category or combination of categories during the Contest Period, through any method or combination of methods of entry. The same photographs may not be submitted to both the Federal Recreation Lands Pass Category and the America at Its Best Category. Multiple Contestants are not permitted to share the same email address, regardless of method of entry. Any attempt by any Contestant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Contestant's Entries and that Contestant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winners may be required to show proof of being the authorized account holder. Proof of sending or submission will not be deemed to be proof of receipt by Sponsors. Released Parties (as defined below) are not responsible for lost, late, delayed, stolen, incomplete, invalid, unintelligible, illegible, damaged, corrupted, misdirected or postage-due Entries, which will be disqualified. All Entries, with the exception of the one hundred twenty five (125) Finalists will be destroyed. - PHOTO GUIDELINES:
Photographs
All photographs must be taken on lands managed by one (1) of the five (5) Federal Recreation Agencies between January 1, 2009 and December 31, 2009. The participating Federal Recreation Agency Lands are: National Park Service, Bureau of Land Management, U.S. Fish & Wildlife Service, the New Melones Reservoir site of the Bureau of Reclamation, and U.S. Forest Service. Photos taken in State Parks do not qualify. Please be sure to accurately label your Entries per the following examples:

Photographs submitted online may not be larger than 5MB in size and must be submitted in .jpg format. Photographs submitted by mail must be at least 3-1/2" x 3-1/2", but no larger than 11" x 14" in size and submitted in 35mm, Advanced Photo System (APS), or medium format film in color print, color slide, black/white, or high resolution digital images. For print Entries, Contestants must retain the negative or original slide. For online Entries, Contestants must retain a copy in a .tif format in the highest resolution possible. No alteration or manipulation of photographs is permitted except for cropping, red eye removal, and/or adjustment of contrast and brightness. Photographs may not be submitted if they depict anything that does not adhere to the rules of the Federal Recreation Agency Lands. Photographs that are inappropriate, indecent or obscene, as determined by Sponsors in their sole discretion, shall be disqualified. All Federal Recreation Lands rules must be followed when taking photographs.
Photographer/Copyright
Entries must be submitted by the original photographer. Photographs taken by someone other than you but submitted by you will not be considered and you may be disqualified. You must be the sole owner of the copyright of any image submitted. Your submission of each photograph is your guarantee that you are the author and copyright holder of such photograph. In addition, by entering, Contestants represent and warrant that the Entries that they submit (i) do not infringe any other person's or entity's rights; and (ii) have not been submitted previously in a contest or promotion of any kind.
Ownership/Use Rights
Contestants retain the copyright to their photographs, and all rights thereto, except as follows. By virtue of a non-exclusive, worldwide, royalty-free, perpetual license for the photographs granted by the Contestants to the Sponsors and Federal Recreation Agencies, Sponsors and Federal Recreation Agencies shall have the right to edit, adapt and publish any or all of the descriptions and/or photographs submitted (collectively, the "Entries"), and may use them in any media in association with the Contest without compensation to the Contestant, his or her successors or assigns, or any other entity. By entering the Contest, Contestants agree to have their submitted photograph used and displayed, either singly or in combination with others and in any size, on the National Park Foundation Gallery Contest website without any fee or other form of compensation due at any time for so long as desired by the National Park Foundation. Photographs will be credited to the Contestant named in the Entry form. Descriptions or titles, if any, used with the photos are in the Sponsors' or Federal Recreation Agencies' sole discretion. In the event that ownership of any photograph submitted is challenged in any manner by any person, Sponsors or Federal Recreation Agencies' may disqualify that photograph and will discontinue use of the photograph. - WINNER DETERMINATION: Winners will be determined via the process set forth below.
(a) Judging Phase:
- Federal Recreation Lands Pass Category: During the Judging Phase, Administrator will review all Entries and will determine the top twenty-five (25) Entries in each of the five (5) Federal Recreation Agency Lands as "Finalists" based on the following criteria: (i) creativity of photograph, (ii) photographic quality, (iii) general visual appeal, (iv) visual appeal based on the photograph's appearance when reduced to the size of the pass (2" x 3.5"), (v) appropriateness of photograph to the theme of the Contest, (vi) ability to show diversity of the Federal Recreation Lands, (vii) enjoyment of the Federal Recreation Lands, and (viii) richness of the Federal Recreation Lands ("Judging Criteria"). Each criteria will be given equal consideration. In the event of a tie for the final spot of any of the five (5) Federal Recreation Agency Lands categories, the Entry judged to be the most creative in the Federal Recreation Agency Lands category will be the Finalist. There will be one hundred twenty five (125) Finalists.
- America at Its Best Category: Qualified judges, whose decisions are final and binding, will choose the Contest winner from among all eligible Entries of the America at Its Best Category based on the following criteria: (i) creativity of photograph, (ii) photographic quality, (iii) general visual appeal, and (iv) appropriateness of photograph to the theme of the category, i.e. the photograph showcases the beauty and richness of America's land preserved unimpaired for the enjoyment of generations.
(b) Voting Phase: During the Voting Phase, the one hundred twenty five (125) Finalists Entries from the Federal Recreation Lands Pass Category will be posted at www.sharetheexperience.org. The public will be invited to vote for their favorite Entry. Limit: Each participant may vote one (1) time per day during the Voting Phase.
For the Voting Phase: Multiple voters are not permitted to share the same email address. Any attempt by any voter to submit more than the stated number of votes by using multiple/different email addresses, identities or any other method will void that voter's Entries (if any) and he/she will be disqualified from further participation in the Contest. Use of any automated system to vote is prohibited and will result in disqualification. Sponsors and Federal Recreation Agencies are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected votes, which will be disqualified. In the event of a dispute as to any vote, the authorized account holder of the email address used to vote will be deemed to be the voter.
(c) Winner Selection: Sponsors and Federal Recreation Agencies, whose decisions regarding the Contest and related matters are final and binding, will choose the top four (4) Contest winners and five (5) of the Honorable Mention winners from among the one hundred twenty five (125) Finalists of the Federal Recreation Lands Category based on the Judging Criteria. The five (5) Entries that receive the highest number of votes during the Voting Phase will be awarded the remaining five (5) Honorable Mention prizes. There will be one (1) Grand Prize winner, one (1) Second Prize winner, one (1) Third Prize winner, one (1) Fourth Prize Winner, and ten (10) Honorable Mentions. There will be one (1) Grand Prize winner selected from the America at Its Best Category by the judges based on the criteria set forth above. Winners for both the Federal Recreation Lands Category and America at Its Best Category will be notified via phone and email or mail by February 18, 2010. Winners must comply with all Contest Rules as published. In the event of a tie for any prize, the Entry judged to be the most creative will win the prize. Each Prize winner, or the parent or legal guardian of such winner, if a winner is a minor in his/her state of residence, will be required to sign and return an affidavit of eligibility and liability/publicity release, where permitted, within ten (10) days from the date of notification. Winner agrees to conduct any and all media interviews related to the Contest if requested and not to criticize or disparage any of the Released Parties during interviews. Failure to comply with this requirement for any reason, return of prize notification or prize as undeliverable, or if a winner is disqualified for any reason will result in forfeiture of the prize, and an alternate winner will be selected by the judges from the remaining eligible Entries and awarded the prize. Only three (3) alternate winners will be selected after which the prize will remain unawarded.
All judging decisions are final.
- PUBLICITY: Acceptance of any prize shall constitute and signify the winner's agreement and consent that Sponsors and/or Federal Recreation Agencies may copy, reproduce, publish, display and use the winner's name, city, state, likeness, age, occupation, photographs and/or prize information for advertising, promotional and publicity purposes worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.

Federal Recreation Lands Pass Category:
ONE (1) GRAND PRIZE: An Olympus E-3 digital single lens reflex (DSLR) camera & 12-60mm lens; Ken Burns "National Parks: America's Best Idea" DVD & Book; a trip for four (4) to a federal recreation land of the winner's choice (excluding American Samoa and Guam) managed by one (1) of the five (5) following agencies: National Park Service, Bureau of Land Management, U.S. Fish & Wildlife Service, Bureau of Reclamation and U.S. Forest Service; and a Federal Recreational Lands Pass. Trip package includes: roundtrip coach-class air transportation for four (4) from a major airport near winner's home (determined by Sponsors in their sole discretion) to the major airport of the city closest to the winner's selected destination; five (5) days and four (4) nights accommodations at a hotel determined by Sponsors in their sole discretion (two (2) rooms, double occupancy); Full-Size rental car for length of stay; and $1,000 spending money. If winner does not meet requirements for rental car, that portion of the prize will be forfeited in its entirety. Winner must complete the trip by June 5, 2011 or prize will be forfeited. Trip is subject to availability and blackout dates. Travel must be roundtrip. Sponsors will determine airline and flight itinerary in their sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Contest, and those set forth by the Sponsors' airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, luggage fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of winner, travel companion(s) must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. If winner is a minor in his/her state of residence, at least one (1) travel companion must be winner's parent/legal guardian. Travel companions must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsors air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsors' sole discretion. For all Prizes: Terms and conditions of the Federal Recreational Lands Pass apply. Actual value of travel prizes may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive the difference between actual and approximate retail value. The ARV of electronic prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsors' sole discretion. Sponsors reserve the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. All prizes (excluding trip elements and the Federal Recreational Lands Passes) will be fulfilled within 8-10 weeks after winners are verified and confirmed. ARV of all prizes: $24,530. - GENERAL RULES: By entering or participating in the Contest, Contestants agree to be bound by these Official Rules. Released Parties assume no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any Entry or other information, or for the failure to capture any such information. Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Contestants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software or the Internet; (3) unauthorized human intervention in any part of the Entry process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of Entries. Further, if, for any reason, the Contest is not capable of running as planned by reason of infection by virus, bugs, worms, trojan horses, other disabling routines or programs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsors and Federal Recreation Agencies, may corrupt, impact or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors and Federal Recreation Agencies reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the Contest, and select the winner for the Contest, from the Entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsors.
Sponsors and Federal Recreation Agencies do not control, nor can control, the flow of data to or from Internet service providers, telecommunications providers, and other portions of the Internet. Such flow depends in large part on the performance of Internet services provided or controlled by third parties. At times, actions or inactions caused by such third parties may produce situations in which a party's connections to the Internet (or portions thereof) may be impaired or disrupted and Sponsors and Federal Recreation Agencies cannot guarantee that such events will not occur. Accordingly, Sponsors and Federal Recreation Agencies disclaim any and all liability resulting from or related to such events. Sponsors and Federal Recreation Agencies shall not be liable to Contestant or any other third party for any claims or damages that may be suffered by Contestant or any such third party including, without limitation, any and all losses or damages of any and every nature, resulting from the loss of data, inability to access the Internet, or inability to transmit or receive information, caused by, or resulting from, delays, non-delivery, or service interruptions whether or not caused by the fault or negligence of Sponsors or Federal Recreation Agencies. Sponsors and Federal Recreation Agencies shall not be responsible for the web site's not being accessible on the Internet due to circumstances not in the direct control of Sponsors such as, without limitation, the other party's equipment capabilities, limitations or Internet service provider limitations. Sponsors and Federal Recreation Agencies shall not have any responsibility or liability for unauthorized dissemination of any data, whether as a result of defeat of data security, misappropriation or misuse of passwords, or any other cause not in the direct control of Sponsors or Federal Recreation Agencies.
Sponsors, Federal Recreation Agencies and Contestant expressly acknowledge and agree that the limitations and exclusions contained herein represent the parties' agreement as to the allocation of risk among the parties in connection with Sponsors' or Federal Recreation Agencies' obligations under these rules. The prizes awarded by Sponsors to the winning Contestants reflect this allocation of risk and the exclusion of consequential damages notwithstanding that any exclusive remedy shall fail of its essential purpose or otherwise be unavailable.
Contestants, by participating in this Contest, hereby waive and release, and agree to hold harmless the Sponsors, the Federal Recreation Agencies, the Administrator, all promotions and advertising agencies, and their respective parents, subsidiaries, affiliates, distributors, advertising and promotions agencies and all of their respective officers, directors, employees, representatives and agents (collectively the "Released Parties"), from and against, any and all rights including without limitation, moral rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including, but not limited to, any injury, loss, damage, whether direct, indirect, compensatory, special, exemplary, incidental or consequential, or other economic loss, to any person, including death and damages to all property (both tangible and intangible), arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Contest, or their participation in the Contest, or their participation in any Contest or prize related activity, or any travel related to the Contest or any travel for any prize related activity. Winner also further acknowledges that Sponsors, the Federal Recreation Agencies, their parents, affiliates, subsidiaries, employees, officers, directors, and promotions and advertising agencies have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or this Contest including, but not limited to, quality, suitability, merchantability, condition or fitness for a particular purpose. The Sponsors, Federal Recreation Agencies and Administrator, hereby expressly disclaim any and all warranties, express or implied, and are expressly released by Contestants from all direct, indirect, special incidental or consequential, or other economic loss arising in whole or part, directly or indirectly, from conduct and administration of or participation in the Contest or use of the Entries as permitted under these rules. Some states do no allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to a particular Contestant. Nor do some states permit the waiver or release of claims which are not known or suspected to exist at the time a waiver and release are agreed to, and with full knowledge of such laws, Contestant agrees expressly to forego and not to ever assert, to the extent permissible under applicable law, directly or indirectly, any rights Contestant may have under either such laws or common law principles of similar effect or otherwise. In no event shall Sponsors be liable to Contestants or any person based on any theory or recovery, whether in contract, tort, or strict liability or otherwise, in an amount in excess of the approximate retail value of the total prizes offered under this Contest.
